Decision No. 1880/QD-BKHDT dated December 22th, 2017 by the Minister of Planning and Investment.

Article 1. Position and functions

The Department of Legislation is under the Ministry of Planning and Investment and assists the Minister in monitoring and performing functions of state management by law and organizing the implementation of legislation under the Ministry’s competence.

Article 2. Responsibilities

1. To assume the prime responsibilities for making plans, programs on the formulation of legal documents under the Ministry’s state management.

2. To preside over or coordinate with related units within the Ministry to formulate, organize the implementation of legal documents that related to fields under the Ministry’s management.

3. To participate in giving comments on legal documents that are formulated by ministries, line ministries or local governments as assigned by the Ministry's leaders.

4. To appraise the constitutionality, legality and legal grounds of legal documents drafted by units within the Ministry before submitting them to the Ministry's leaders.

5. To participate in appraising, and giving comments on, investment projects as assigned by the Ministry's leaders or proposed by units within the Ministry.

6. To assume the prime responsibility for organizing the review, systematization, examination, and codification of legal documents; to act as the focal point in making plans for the organization of law dissemination, propagation and education in the fields under the Ministry’s state management.

7. To preside over the negotiation of international treaties on investment; to preside over or participate in the negotiation of international treaties, agreements and other activities related to international economic integration within the Ministry’s management scope.

8. To preside over or participate in guiding the implementation of international treaties and agreements which are mentioned in Item 7; to act as the focal point in formulating policies and organizing the negotiation of the international system of dispute settlement on investment.

9. To preside over or participate in guiding the implementation of legal provisions on investment and business and other legal documents within the Ministry’s management scope.

10. To assume the prime responsibility for organizing the revision, systematization, and examination of the codification of legal documents; to act as a focal point in making plans for the organization of dissemination and propagation the education of law within the fields under the state management of the Ministry.

11. To perform the functions, responsibilities, and authorities of a legislation organization according to laws and regulations.

12. To perform other duties assigned by the Minister of Planning and Investment.

Article 3. Organizational structure

The Department of Legislation has a Director General and a number of Deputy Directors General and works in accordance with the one-head regime combined with the specialist regime, the Department’s personnel is determined by the Minister of Planning and Investment.

Article 4. Entry into force

This Decision takes effect on the date of its signing. The promulgated regulations which are contrary to this Decision are annulled.

Article 5. Implementation responsibilities

The Director General of the Department of Organization and Personnel, the Chief of the Ministry Office, the Director General of the Department of Legislation and Heads of units, organizations under the Ministry are responsible for implementing this Decision./.
