Decision No. 1855/QD-BKHDT dated December 21st, 2017 by the Minister of Planning and Investment
Article 1. Position and functions
The Department of Organization and Personnel is under the Ministry of Planning and Investment, assists the Minister in performing the functions of state management over the organization of apparatus, personnel, the salary regime, regimes and policies on preferential treatment and discipline of civil servants, public employees and contracted employees salaried from the State budget of the Ministry.
Article 2. Responsibilities
1. To submit to the Minister the legal documents, strategies, master plans, plans, statutes, regulations, schemes, projects, tasks on organization and personnel of the Ministry; to guide, examine and organize the implementation after the approval.
2. Regarding apparatus organization:
a) To advise, propose to the Minister measures, solutions for the consolidation of the organization of units within the Ministry and the statistic sector;
b) To appraise and submit to the Minister draft Decisions defining the functions, responsibilities, powers and organizational structure of units within the Ministry and draft Decisions on the establishment, reorganization and dissolution of subunits under units within the Ministry according to law regulations and decentralization of the Ministry; to appraise schemes and documents for the consolidation of functions, responsibilities and organizational structures of units within the Ministry; to guide, examine and urge the formulation and implementation of regulations on the functions, responsibilities and organizational structure of units within the Ministry.
c) To submit the Minister the documents on the establishment of organs that operate to perform specific duties within the Minister’s competence.
3. Regarding working positions and payroll:
a) To guide, appraise the construction of working positions of units within the Ministry to submit to competent authorities for consideration, approval and management according to law regulations and decentralization of the Ministry;
b) To guide the making of plans on civil servant payrolls and the numbers of public employees of units within the Ministry; to synthesize and formulate plans on civil servant payroll and the number of public employees for the Minister to decide according to his competence or submit to competent agencies according to law regulations;
c) To submit to the Minister the decisions assigning annual civil servant payrolls to units assisting the Minister in performing the state management functions, civil servant payrolls and the numbers of employees to non-business units within the Ministry according to regulations.
4. Regarding personnel affairs:
a) To preside over, coordinate with related agencies in formulating and submitting to competent authorities for the promulgation of titles, codes and professional criteria for civil servant ranks in the statistics field;
b) To advise and propose to the Minister the organization of implementing the recruitment, arrangement and assignment of work; the management of civil servant ranks and public employee professional title ranks; salary raise; personnel planning; the appointment, reappointment, rotation, relief of duty, resignation; the retirement, job discontinuation, unpaid leaves, staff reduction; admission, readmission, transfer, secondment, job move, periodical shift; evaluation and classification of civil servants and public employees; asset and income declaration; personnel records management; discipline; other regimes and policies applicable to civil servants, public employees and contracted employees salaried from state budget of units within the Ministry according to law regulations and decentralization of the Ministry;
c) To submit to the Minister decisions appointing and permitting civil servants, public employees and contracted employees salaried from the State budget for domestic and abroad business trips; to process the permits for civil servants, public employees and contracted employees salaried from the State budget of units within the Ministry to go abroad for private business according to law regulations and decentralization of the Ministry.
5. Regarding training and retraining:
a) To preside over, coordinate with units within the Ministry in making plans and allocating annual personnel training and retraining funds granted by the State; to guide, examine and urge units within the Ministry in the implementation of training and retraining civil servants, public and contracted employees according to the approved master plans and plans;
b) To preside or coordinate with units within the Ministry to organize the compilation and appraisal of programs and documents for specialized and professional training and retraining as assigned by the Minister;
c) To preside or coordinate with units within the Ministry to organize classes for specialized and professional training and retraining for civil servants, public employees and contracted employees salaried from the State budget within the Ministry of Planning and Investment, and local organizations and units of planning and investment sector as assigned by the Minister;
d) To formulate plans and organize the implementation of appointing civil servants, public employees and contracted employees salaried from the state budget for overseas training and retraining funded by the state budget and other sources;
e) Assist the Minister in managing the Economic - Planning Cadre Training Center, Academy of Policy and Development, Da Nang Economic - Planning College and other training facilities belong to the Ministry according to law regulations and decentralization of the Ministry.
6. To act as the standing unit of the Office of the Party Civil Affairs Committee, to perform the function of an Assisting Office for the Party Civil Affairs Committee of the Ministry of Planning and Investment in preparing contents and documents for the meetings of the Party Civil Affairs Committee to discuss internal affairs of the Ministry, meetings and working sessions of the Party Civil Affairs Committee with the Commissions of the Party Central Committee; preparing the draft annual summation and review reports of the Party Civil Affairs Committee, the draft reports on the implementation of the Party's guidelines and Resolutions as assigned by the Party Civil Affairs Committee; receiving, transferring and archiving files, documents and seals of the Party Civil Affairs Committee according to regulations; and other duties as assigned.
7. Assist the Minister in managing press units within the Ministry in accordance with the law regulations and decentralization of the Ministry; master plans and plans for organizing the system of press units within the Ministry; to submit guidelines to the Minister for approval and reporting to competent authorities on the grant, modification, supplementation, and revocation of licenses for activities of the printing press and electronic media; to rate press agencies; to act as the focal point in reporting the organization and operation of the press units within the Ministry.
8. To carry out the protection of the internal politics of the Ministry’s agencies and regulations on the protection of State secrets in the organization and personnel of the Ministry according to law regulations.
9. To preside over and coordinate with units under the Ministry in implementing grassroots democracy regulations; regulations on thrift practice and waste combat; regulations on corruption prevention and combat according to law regulations in organization and personnel.
10. To preside over and coordinate with units within the Ministry in performing the tasks of managing associations in the fields under the Ministry’s management according to regulations.
11. To perform the tasks of administrative reformation, youth work, gender equality, family and children, ethnicity, religion and beliefs.
12. To perform the examination, participate in the inspection of the implementation of law regulations on apparatus organization, personnel; salary and preferential regimes and policies for civil servants, public employees and contracted employees salaried from state budget of the Ministry; settlement of complaints and denunciations; prevention and combating of corruption and negativity according to law regulations and the Ministry's decentralization.
13. To organize the implementation of tasks of international cooperation, scientific research, law dissemination and education in the fields within the scope of the Department’s functions.
14. To participate in giving comments on the documents on regimes and policies related to the organization and personnel; to make periodical and unscheduled statistics and reports on performance of tasks in assigned fields.
15. To manage the contingent of civil servants and assets of the Department in accordance with law regulations and decentralization of the Ministry; to participate in Drafting Committees, Editorial Teams of projects for formulation of legal documents, according to law regulations and the decentralization of the Ministry.
16. To perform other duties assigned by the Minister of Planning and Investment.
Article 3. Organizational structure
The Department of Organization and Personnel has a Director General and a number of Deputy Directors General and works in accordance with the one-head regime combined with the specialist regime, the Department’s personnel is determined by the Minister of Planning and Investment.
Article 4. Entry into force
This Decision takes effect on the date of its signing. The previously promulgated regulations which are contrary to this Decision are annulled.
Article 5. Implementation responsibilities
The Director General of the Organization and Personnel, the Chief of the Administration Office and Heads of units, organizations within the Ministry are responsible for implementing this Decision./.
